These Terms & Conditions govern your use of Forged in Mud and any purchases you make through our website. We've written them in plain language so you actually understand what you're agreeing to. Please read them before placing an order.

By accessing our website or completing a purchase, you agree to these terms. If you don't agree, please don't use our site.

1. Who We Are

Forged in Mud ("we," "our," or "us") operates the ecommerce store at https://www.forgedinmud.ca/.

2. Eligibility

To use our website and place an order, you must:

  • Be at least 18 years of age (or 13 with verified parental consent)

  • Be a human — automated bots and scrapers are not permitted

  • Provide accurate, current, and complete information during checkout or account creation

  • Have the legal authority to enter into a binding agreement in your jurisdiction

We reserve the right to refuse service to anyone at any time, for any lawful reason.

3. Your Account

If you create an account with us:

  • You are responsible for keeping your login credentials secure

  • You are responsible for all activity that occurs under your account

  • You must notify us immediately at customerservice@forgedinmud.ca if you suspect unauthorized access

  • We reserve the right to suspend or terminate accounts that violate these terms

  • You may only maintain one account per person

You can delete your account at any time by contacting us or through your account settings.

4. Products & Availability

  • All products are subject to availability and we cannot guarantee stock at any given time. If your product is out of stock, we will check for the most compatible replacement of equal or higher value and fulfill your order. We will cover the difference in price if the amount is more.

  • We reserve the right to discontinue any product without notice

  • Product images are for illustrative purposes — minor variations in color or appearance may occur due to photography and screen settings

  • We reserve the right to limit quantities purchased per customer or household

  • Prices and availability are subject to change without notice

5. Pricing & Payment

  • All prices are listed in [CAD] and are exclusive of applicable taxes unless otherwise stated

  • Sales tax will be calculated and applied at checkout based on your shipping address

  • We accept the following payment methods: Visa, Mastercard, Google pay, Apple pay, Amex, Discover Card.

  • Payment is processed securely by Wix Payments / Google Pay / Apple Pay — we do not store your raw payment details

  • By submitting an order, you authorize us to charge your selected payment method for the total amount shown at checkout

  • If a payment is declined, we reserve the right to cancel your order

  • In the event of a pricing error, we reserve the right to cancel affected orders and issue a full refund

6. Orders & Contract Formation

  • Placing an order constitutes an offer to purchase — not a confirmed contract

  • A binding contract is formed only when we send you an order confirmation email

  • We reserve the right to refuse or cancel any order at our discretion, including orders that appear fraudulent, contain errors, or exceed available stock

  • If we cancel your order after payment has been collected, you will receive a full refund within [5–10] business days

7. Shipping & Delivery

  • We ship with in Canada Only at this time

  • Estimated delivery timeframes are provided at checkout and are estimates only — not guarantees

  • We are not responsible for delays caused by holidays, weekends, carriers, customs, weather, or events outside our control

  • Risk of loss and title for items transfer to you upon delivery to the carrier

  • You are responsible for providing an accurate and complete shipping address — we are not liable for orders lost due to incorrect addresses

  • International customers are responsible for any applicable customs duties, import taxes, or brokerage fees

8. Returns, Refunds & Exchanges

  • All Refunds, size exchanges, exchanges and defects must be reported to our claims department with in 30 days from the day of purchase to be eligible.​

  • All items will be inspected and must be in its original state, unworn and unwashed and still have the original barcode sticker label attached.​

  • Any errors such as misprints, damage from delivery/defects, wrong items or size's shipped and lost in transit due to no error on your part will be deemed to be corrected by Forged In Mud at Forged In Mud's expense.​

  • Size exchanges will also be covered at Forged In Mud's expense for the shipping and re shipping of the item (please be sure of your size when ordering. If you prefer a loose baggy hoodie always go up one size at least)​

  • Exchanges for one item to another will be honored minus the shipping fee to return your item(s) for exchange, this is paid by the customer along with any price adjustments if the new ordered item is more and a price adjustment will be completed and the difference will be refunded to your original form of payment if the new item is less.​

  • ​Buyers remorse will be refunded minus all shipping fees ​

  • All Items are created for each individual order. We understand that if we misprinted/, damage, or defect any items that you receive, a clear photo and a description of the issue regarding the item must be submitted within 30 days from the day of purchase and the items must be in their original, unused and unworn condition. ​

  • We take quality seriously. If something isn't up to standard, we want to know about it.

  • Please take clear photos, include your name, phone number, order number, item with description of the issue along with your full address and submit your request to claims@forgedinmud.ca Once your claim is started and you have been given instructions on how to return, you have 5 days to ship the item for the claim to remain open so we may track the shipment.​​​

  • We aim to respond to all inquiries within 2-4 business days.

9. Intellectual Property

All content on our website — including but not limited to logos, product images, copy, graphics, videos, and the overall design — is the intellectual property of Forged in Mud or our licensed partners.

You may not:

  • Copy, reproduce, or redistribute our content without written permission

  • Use our branding, trademarks, or trade dress in any way that suggests endorsement

  • Scrape, crawl, or extract data from our website using automated tools

  • Create derivative works based on our content or product designs

Personal, non-commercial use (such as sharing a product link) is permitted.

10. User-Generated Content

If you submit reviews, photos, comments, or other content on our site:

  • You grant us a non-exclusive, royalty-free, worldwide license to use, display, and share that content for marketing and operational purposes

  • You confirm that your content does not infringe on any third-party rights

  • You agree not to submit content that is false, defamatory, harassing, obscene, or otherwise unlawful

  • We reserve the right to remove any content at our discretion without notice

11. Prohibited Uses

When using our website, you agree not to:

  • Violate any applicable local, national, or international law or regulation

  • Engage in fraudulent, deceptive, or misleading conduct

  • Attempt to gain unauthorized access to our systems, accounts, or databases

  • Transmit viruses, malware, or any other harmful code

  • Use our site to harass, threaten, or harm others

  • Interfere with the proper functioning of our website or servers

  • Resell our products commercially without prior written authorization

Violations may result in immediate account termination and, where appropriate, referral to law enforcement.

  • Our website will be uninterrupted, error-free, or free of viruses

  • Product descriptions, pricing, or other content will always be accurate or complete

  • Results from using our products will meet your specific expectations

Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

13. Limitation of Liability

To the maximum extent permitted by law, Forged in Mud will not be liable for:

  • Indirect, incidental, special, or consequential damages

  • Loss of profits, revenue, data, or business opportunities

  • Damages arising from your use of or inability to use our website

  • Any damages exceeding the total amount you paid us in the [12] months preceding the claim

14. Indemnification

You agree to indemnify, defend, and hold harmless Forged in Mud, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your violation of these Terms & Conditions

  • Your use of our website or products

  • Your infringement of any third-party rights

  • Any content you submit to our platform

15. Third-Party Links & Services

Our website may contain links to third-party websites or integrate third-party services. We are not responsible for the content, policies, or practices of any third-party site. Links do not constitute endorsement. Use third-party services at your own risk.

16. Governing Law & Disputes

These Terms & Conditions are governed by and construed in accordance with the laws of Alberta, Canada, without regard to its conflict of law provisions.

Any disputes arising from these terms or your use of our site will be resolved as follows:

  • Informal resolution first — contact us first at, customerservice@forgedinmud.ca and we will make every effort to resolve the issue within 30 days

  • Binding arbitration — If informal resolution fails, disputes will be submitted to binding arbitration under the rules of Forged In Mud’s choice of a binding arbitrator.

  • No class actions — You agree to resolve disputes individually and waive the right to participate in class action lawsuits

Note: Some jurisdictions do not allow mandatory arbitration clauses. This clause may not apply to you depending on your location.

17. Changes to These Terms

We reserve the right to update these Terms & Conditions at any time. When we do:

  • We will update the "Last Updated" date at the top of this page

  • We will notify you by email for significant changes

  • Your continued use of our website after changes are posted constitutes acceptance of the updated terms

We encourage you to review this page periodically.

18. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

19. Entire Agreement

These Terms & Conditions, together with our Privacy Policy, Shipping Policy, and Returns Policy, constitute the entire agreement between you and Forged In Mud Ltd. regarding your use of our website and supersede any prior agreements.
